1. Order processing times
Orders will be processed within two business days of receipt. Once the purchase is completed and the order confirmation email is received, the orders will be dispatched. Delivery times may vary depending on the chosen product, but never earlier than 2 (two) business days. Dispatch may experience delays during holidays. Orders will be dispatched and delivered from Monday to Friday, excluding holidays and national holidays. MISTER KIT SAS DI G. GIANELLI is not responsible for unforeseeable delays, provided that, except in cases of force majeure, the Products will be delivered within a maximum period of 20 (twenty) days from the day following the day on which the Customer placed the order with MISTER KIT SAS DI G. GIANELLI.
The delivery day will depend on the destination location and the availability of the ordered merchandise. Deliveries are not made on holidays and pre-holidays.
2. Delivery methods
Product deliveries are made to the address provided by the Customer during the purchase process through the carrier throughout Italy, except for Campione D'Italia and Livigno. The carrier assumes full responsibility for transportation, from pickup at the supplier to delivery to the specified address. MISTER KIT SAS DI G. GIANELLIdoes not assume any responsibility for any damages or irregular behavior by the carrier.
You can choose the most convenient shipping address: your residence, office, or another person's address. The presence of the Customer or their representative is required at the recipient's address indicated in the order for merchandise delivery.
No responsibility can be attributed to MISTER KIT SAS DI G. GIANELLI in case of delays in order processing or delivery of the ordered items.
Upon delivery, the customer is required to check:
- that the packaging is intact, not damaged, wet, or otherwise altered, including sealing materials;
- that the number of packages matches what is indicated in the transport document.
Any damage to the product or packaging or discrepancies in the indications must be immediately reported to the courier by writing "RESERVE OF CONTROL CONTENT" on the courier's delivery receipt. Once the courier's document is signed, the Customer cannot contest any external characteristics of the delivered items.
In case of non-collection within 5 working days of the material held in stock at the courier's warehouses due to repeated impossibility of delivery to the address indicated by the Customer at the time of order, the order will be canceled.
If any product presented on the portal is no longer available or for sale at the time of conclusion of the purchase, MISTER KIT SAS DI G. GIANELLI will communicate the inconvenience within 15 (fifteen) days from the day following the transmission. In case the Customer has already paid for the order, MISTER KIT SAS DI G. GIANELLIwill provide a full refund as soon as possible, and in any case, no later than 30 (thirty) days from the receipt of the purchase order. For security reasons, deliveries to post office boxes will not be made, and the order will not be processed.
3. Payment methods
For each order placed, MISTER KIT SAS DI G. GIANELLI issues a sales document for the shipped material. For invoicing purposes, the information provided by the customer at the time of the order is valid. The Customer can request a copy of the invoice or fiscal receipt within three months from its issuance.
Delivery costs are borne by the Customer and are indicated during the order process unless clearly stated otherwise in the sales offer.
All prices on the website are considered retail prices and, therefore, include VAT. Prices are subject to change without notice, and the only correct price is the one indicated at the time of order confirmation.
On certain products subject to price promotions, the seller reserves the right to accept orders by reducing the quantity, subject to communication and acceptance by the customer; otherwise, the order will be canceled.
In the case of purchasing merchandise using the "credit card" payment method, the bank will only authorize the amount relating to the purchase at the time of the online transaction.
Upon request, an invoice for the shipped goods can be issued to the order holder, in accordance with D.P.R. 445/2000 and D.L. 52/2004. For invoicing purposes, the information provided by the Customer at the time of the order is valid. No changes to the invoice will be possible after its issuance.
The shipment of the goods will only take place after the order is accepted and payment is received.
In the event of an order cancellation, either by the Customer (for the reasons indicated in the following point 4B) or in the event of non-acceptance by the seller for reasons not attributable to their will, the order will be canceled, and the amount committed will be released (the timing of release depends solely on the banking system). After canceling the transaction, the seller cannot be held responsible for any damages resulting from the release of the amount committed by the banking system.
MISTER KIT SAS DI G. GIANELLI reserves the right to request additional documents from the Customer to prove the ownership of the credit card. Failure to send the requested documentation allows MISTER KIT SAS DI G. GIANELLI to reject the order. Transaction security is guaranteed by a data encryption system (SSL) and secure, certified connections.
4. Withdrawal & legal guarantee
A. Legal guarantee
The purchased products are always accompanied by a legal guarantee covering manufacturing defects.
The legal guarantee cannot be invoked by those who purchased the products within the scope of their business or professional activity, indicating their VAT number.
The legal guarantee entitles the Customer to request from MISTER KIT SAS DI G. GIANELLI the replacement of the product, free of charge, provided that the requested solution is not impossible or excessively burdensome, taking into account: the extent of the defect, the value of the product without defects, and the possibility of implementing the alternative without causing significant inconvenience to the Customer;
in case repair or replacement is impossible, excessively burdensome, or late or if it fails to resolve the problem effectively, the Customer has the right to request a price reduction. In determining the amount of the reduction, the use of the product must be taken into account. In any case, for minor defects for which the replacement of the product was not possible, the contract cannot be terminated.
The seller will replace the product within a maximum of 30 days from delivery.
To enforce the guarantee, the Customer must, by law:
- keep and show the purchase receipt;
- report the defect within seven days of its discovery;
B. Right of withdrawal
MISTER KIT SAS DI G. GIANELLI reserves the right not to accept goods from the same order, returned and shipped at different times. The costs of returning the goods will be borne by the customer, including liability in the event of loss or damage to the products.
In the event that there is no correspondence between the recipient of the products indicated in the order and the person who made the payment of the sums due for their purchase, the refund of the sums, in the event of exercising the right of withdrawal, will be towards the person who made the payment.
The online customer who acts as a consumer is granted the right to withdraw from the contract, as provided for by articles 64 - 67 of Legislative Decree no. 206/2005, known as the Consumer Code.
It should be noted that this right is reserved only for natural persons, i.e. those private consumers who act for purposes other than their profession. There is no right of withdrawal for legal and natural persons acting, in reference to the purchase contract, in a professional context.
Pursuant to and within the limits of art. 64 of the Consumer Code, the consumer has the right, within 14 working days of receiving the purchased products, to exercise the right of withdrawal, consisting in the possibility of returning the products received and obtaining a refund of the price paid, without penalty and without the need to specify the reason.
This right applies to all products purchased online on this site.
The costs of returning the product are borne by the consumer.
The right of withdrawal lapses entirely if the returned product is not intact, for example due to the absence of integral elements of the product or because the product has suffered damage for reasons other than transport from the Seller to the consumer, not previously reported.
Without limitations on the right of withdrawal, upon delivery of the product, the consumer, who has reason to believe that the product itself has been damaged during transport, must refuse delivery or accept it with express reservation.
Each collection of intact packages must be made by the customer by writing "INTEGRAL PACKAGE, COLLECTION WITH RESERVATION OF CONTENT CONTROL" on the accompanying document (art. 1698 Civil Code). Any anomaly must then be reported within eight days.
Procedure for exercising the right of withdrawal
To exercise the right of withdrawal, it is necessary to send, within 14 working days of receiving the purchased product, a communication in which the intention to withdraw from the purchase contract is clearly expressed.
This communication must be sent by registered letter with acknowledgement of receipt.
The communication can also be sent, within the same term, by telegram (to the company address).
The consumer must then arrange, using a courier of his choice, the shipment of the product (if possible in the original packaging and, in any case, always carefully packaged) and everything originally contained. The consumer must make this shipment within ten working days from the date on which he sent the communication of exercising the right of withdrawal.
Important Notes
Transport costs and responsibility for the goods during shipping, as required by law, are the responsibility of the consumer.
It is therefore advisable to insure the product with the chosen courier, taking care to carefully package the goods, where possible by placing the original packaging in an external box and, in any case, avoiding damaging the product with adhesive tapes, labels, etc. The product must be returned intact and complete with all its parts and accessories, including any guarantees. In the event of transport damage occurring during the return, MISTER KIT SAS DI G. GIANELLI will communicate the damage to the consumer within five working days of receiving the product, allowing the consumer to file a complaint with the courier used for transport. The damaged goods will be made available for return and the request for withdrawal will be simultaneously cancelled. Except as provided below for the case of partial withdrawal, MISTER KIT SAS DI G. GIANELLI will refund, within 30 days from the moment in which MISTER KIT SAS DI G. GIANELLI became aware of the exercise of the right of withdrawal, the entire purchase amount and the shipping costs for delivery, by means of a credit card reversal procedure or by bank transfer to the current account indicated by the consumer; the latter will be responsible for the shipping costs for returning the product.
If the withdrawal is partial (i.e. it concerns only a part of the products delivered with a single delivery), the refund of the shipping costs incurred by the consumer for the delivery of the products at the time of purchase is excluded.
Request for Cancellation of the Order
The purchase order can be cancelled in full if, at the time of the cancellation request, the shipment of the product is still being prepared and, in any case, if the amount has not yet been collected; in this case no cost will be charged to the Customer. If at the time of the request to cancel the purchase order the product has already been entrusted to the courier or, in any case, the amount has been collected, the consumer must exercise the right of withdrawal and return the goods to MISTER KIT SAS DI G. GIANELLI.
To this end, it is necessary to follow the procedures indicated above for exercising the right of withdrawal.
Each User is prohibited, either for themselves or on behalf of someone else:
- use the MISTER KIT SAS DI G. GIANELLI website for illegal, illicit or unauthorized purposes or that may infringe any third party rights, including industrial/intellectual property rights, privacy rights, etc.;
- impersonate the identity of others, hide one's identity or provide false information directly or indirectly;
- carry out propaganda, sponsorship, advertising or professional commercial activities through the Portal;
- copy, modify, alter in any way any section of the MISTER KIT SAS DI G. GIANELLI website; cause harm to third parties or other Users.
