Right of Withdrawal
Pursuant to and within the limits of Art. 64 of the Consumer Code, the consumer has the right—within 14 working days of receiving the purchased products—to exercise the right of withdrawal. This entails the option to return the products received and obtain a refund of the price paid, without penalty and without the need to provide a reason.
This right applies to all products purchased online on this site. The costs of returning the product are borne by the consumer. The right of withdrawal is forfeited entirely if the returned product is not intact—for example, due to the absence of integral components—or if the product has sustained damage not previously reported and caused by factors other than transport from the Seller to the consumer. Without limiting the right of withdrawal, upon delivery, any consumer who has reason to believe the product was damaged during transport must either refuse delivery or accept it with an express reservation.
When accepting delivery of intact packages, the customer must sign the accompanying document with the wording "INTACT PACKAGE, ACCEPTED SUBJECT TO INSPECTION OF CONTENTS" (Art. 1698 of the Civil Code). Any discrepancies must subsequently be reported within eight days.
Statutory Warranty
Purchased products are always covered by a statutory warranty against manufacturing defects.
The statutory warranty cannot be claimed by those who purchased the products as part of their business or professional activities (i.e., by providing a VAT number).
The statutory warranty entitles the Customer to request that MISTER KIT SAS DI G. GIANELLI replace the item free of charge, provided that the requested solution is not impossible or excessively burdensome, taking into account: the severity of the defect, the value of the product without the defect, and whether an alternative solution could be implemented without causing significant inconvenience to the Customer. If repair or replacement proves impossible, excessively burdensome, delayed, or causes significant inconvenience to the Customer without effectively resolving the issue, the Customer is entitled to request a price reduction. The amount of the reduction must take into account the extent to which the item has been used. In any case, the contract cannot be rescinded for minor defects where product replacement was not possible.
The seller shall replace the product within a maximum of 30 days from delivery.
To claim the warranty, the Customer is legally required to: - keep and present the receipt or proof of purchase; and - report the defect within 8 days of discovering it.
Procedure for Returns/Exchanges/Withdrawal:
The return/exchange/withdrawal request can be made directly on the site through the "Orders" management section or with a clear and detailed communication via email or certified email. (PEC). Such communication may also be sent via registered mail to the company's address.
The consumer must then arrange for the shipment of the product—using a courier of their choice—along with all original contents; the product should ideally be in its original packaging but must, in any case, be carefully packed. This shipment must be made within ten working days of the date the notice of withdrawal was sent.
MISTER KIT SAS DI G. GIANELLI reserves the right not to accept goods belonging to the same order if they are returned and shipped at different times. Return shipping costs are to be borne by the customer, who also bears liability for any loss of or damage to the products. In the event that the product recipient listed in the order differs from the person who made the payment, any refund issued upon withdrawal will be made to the person who made the payment. Online customers acting as consumers are granted the right to withdraw from the contract, as provided for in Articles 64–67 of Legislative Decree no. 206/2005 (the Consumer Code). Please note that this right is reserved solely for natural persons—i.e., ...to those private consumers acting for purposes outside their profession. No right of withdrawal is available to legal entities or natural persons acting in a professional capacity in relation to the purchase contract.
Important notes: As required by law, shipping costs and liability for the goods during transit are borne by the consumer. It is therefore recommended to insure the product with the chosen carrier and to pack the goods carefully—placing the original packaging inside an outer box whenever possible—while ensuring the product itself is not damaged by adhesive tape, labels, etc. The product must be returned intact and complete with all parts and accessories, including any warranty documents. In the event of damage occurring during the return shipment, MISTER KIT SAS DI G. GIANELLI will notify the consumer within five working days of receipt, enabling the consumer to file a claim with the carrier used for transport. The damaged goods will be made available for return, and the withdrawal request will be simultaneously cancelled. Except as otherwise provided below regarding partial withdrawal, MISTER KIT SAS DI G. GIANELLI will refund the full purchase price and original delivery costs within 30 days of becoming aware of the exercise of the right of withdrawal; this refund will be processed via a credit card reversal or a bank transfer to the account specified by the consumer. The consumer remains responsible for the costs of returning the product. In the event of partial withdrawal (i.e., involving only some of the products delivered in a single shipment), the shipping costs originally paid by the consumer for the delivery of the products are non-refundable.
